• Discord Bot: Discord integration for blacklist management and queries
• Web Interface: Browser-based access to blacklist information and account management
• Game Activity Tracking: Real-time monitoring and logging of game sessions and player interactions

3. User Accounts and Registration

3.1 Account Creation

To access certain features, you must:

• Register through our Discord bot using your Discord account
• Provide accurate and complete information
• Maintain the confidentiality of your API keys
• Keep your account information current and accurate

3.2 Account Security

You are solely responsible for:

• Maintaining the security and confidentiality of your API keys
• All activities that occur under your account
• Immediately notifying us of any unauthorized use
• Taking precautions to prevent unauthorized access

3.3 Account Suspension and Termination

We reserve the right to suspend, terminate, or restrict your account at any time for:

• Violation of these Terms or our community guidelines
• Fraudulent, abusive, or illegal activities
• Compromised account security
• At our sole discretion with or without cause

4. Acceptable Use Policy

• Share Credentials: Share, sell, or transfer your API keys or account access
• Submit False Information: Submit inaccurate, misleading, or malicious tags or reports
• Abuse the System: Attempt to bypass rate limits, security measures, or access restrictions
• Harassment: Use our Services to harass, threaten, or harm other users
• Automated Abuse: Use bots, scrapers, or automated tools without explicit permission
• Reverse Engineering: Attempt to reverse engineer, decompile, or extract our source code
• Commercial Abuse: Use our Services for unauthorized commercial purposes
• Legal Violations: Use our Services for any illegal activities

5. Content and Data

5.1 User-Generated Content

When you submit content (tags, reports, messages), you:

• Grant us a perpetual, worldwide, royalty-free license to use, display, and distribute your content
• Represent that your content is accurate and does not violate any rights
• Understand that your content may be publicly visible and permanently retained
• Remain solely responsible for the accuracy and legality of your content

5.2 Tag Submission Guidelines

When submitting player tags, you must:

• Base tags on concrete, observable evidence
• Provide detailed and accurate reasons
• Use appropriate tag categories and severity levels
• Update or correct tags if new information becomes available
• Not submit tags based on hearsay, speculation, or personal disputes

5.3 Data Accuracy Disclaimer

IMPORTANT DISCLAIMER: WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF USER-SUBMITTED CONTENT. ALL BLACKLIST DATA IS PROVIDED "AS-IS" AND USERS SHOULD EXERCISE THEIR OWN JUDGMENT. URCHIN IS NOT RESPONSIBLE FOR FALSE OR MISLEADING PLAYER TAGS SUBMITTED BY USERS.

6. Game Activity Tracking

⚠️ IMPORTANT PRIVACY NOTICE: BY USING OUR SERVICES, YOU EXPRESSLY CONSENT TO COMPREHENSIVE GAME ACTIVITY TRACKING, INCLUDING:

• REAL-TIME MONITORING of your game sessions and player interactions
• COLLECTION AND LOGGING of Discord IDs, usernames, and Minecraft player data
• AUTOMATIC SHARING of game session information via Discord webhooks
• INDEFINITE RETENTION of tracking data in Discord server logs
• ANALYSIS of gaming patterns and behavioral data

THIS TRACKING OCCURS AUTOMATICALLY DURING API USAGE AND CANNOT BE DISABLED WHILE USING OUR SERVICES. BY CONTINUING TO USE OUR SERVICES, YOU ACKNOWLEDGE AND CONSENT TO THIS COMPREHENSIVE TRACKING.

7. Privacy and Data Protection

Your privacy is governed by our Privacy Policy, which is incorporated by reference. Key points include:

• NO WARRANTY OF AVAILABILITY: SERVICES MAY BE TEMPORARILY UNAVAILABLE OR INTERRUPTED
• NO WARRANTY OF SECURITY: WHILE WE IMPLEMENT SECURITY MEASURES, NO SYSTEM IS COMPLETELY SECURE
• NO WARRANTY OF COMPATIBILITY: SERVICES MAY NOT WORK WITH ALL SYSTEMS OR SOFTWARE
• NO WARRANTY OF MERCHANTABILITY OR FITNESS: WE DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT

11.2 LIMITATION OF LIABILITY

LIMITATION OF DAMAGES: TO THE MAXIMUM EXTENT PERMITTED BY LAW, URCHIN, ITS OPERATORS, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF DATA, CONTENT, OR ACCOUNT INFORMATION
• LOSS OF PROFITS, REVENUE, OR BUSINESS OPPORTUNITIES
• BUSINESS INTERRUPTION OR LOSS OF USE
• PERSONAL INJURY OR PROPERTY DAMAGE
• ACTIONS BY OTHER USERS OR THIRD PARTIES

DAMAGE CAP: IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED ONE HUNDRED DOLLARS ($100 USD) OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM, WHICHEVER IS GREATER.

THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY UPON WHICH YOUR CLAIM IS BASED, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. INDEMNIFICATION

USER INDEMNIFICATION: YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS URCHIN, ITS OPERATORS, AFFILIATES, EMPLOYEES, AGENTS, AND REPRESENTATIVES FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, LIABILITIES, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES) ARISING FROM:

• YOUR USE OR MISUSE OF OUR SERVICES
• YOUR VIOLATION OF THESE TERMS OR ANY APPLICABLE LAWS
• YOUR VIOLATION OF ANY THIRD-PARTY RIGHTS, INCLUDING PRIVACY, PUBLICITY, OR INTELLECTUAL PROPERTY RIGHTS
• CONTENT YOU SUBMIT, POST, OR SHARE THROUGH OUR SERVICES
• YOUR INTERACTION WITH OTHER USERS OF OUR SERVICES

13. Dispute Resolution

13.1 Informal Resolution

Before pursuing formal legal action, you agree to first contact us through our Discord server to attempt to resolve any disputes informally.

13.2 BINDING ARBITRATION

MANDATORY ARBITRATION: ANY DISPUTES THAT CANNOT BE RESOLVED INFORMALLY SHALL BE RESOLVED THROUGH BINDING ARBITRATION ON AN INDIVIDUAL BASIS, EXCEPT FOR:

• CLAIMS FOR INJUNCTIVE RELIEF
• CLAIMS INVOLVING INTELLECTUAL PROPERTY
• SMALL CLAIMS COURT MATTERS

13.3 CLASS ACTION WAIVER

CLASS ACTION WAIVER: YOU EXPRESSLY WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS, REPRESENTATIVE ACTIONS, OR CLASS-WIDE ARBITRATION AGAINST US. ALL DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS ONLY.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Urchin operates, without regard to conflict of law principles. Any legal proceedings shall be brought in the appropriate courts of that jurisdiction.

15. International Use

If you access our Services from outside our primary jurisdiction:

• You do so at your own risk and initiative
• You are responsible for compliance with local laws
• Data may be transferred to and processed in other countries
• Some features may not be available in all regions

16. Age Requirements and Parental Consent

Our Services are not intended for children. Users must be:

• At least 13 years old (or 16 in the European Union)
• Able to form legally binding contracts
• In compliance with Discord's Terms of Service

If we become aware of users under the minimum age, we will terminate their accounts.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect. The unenforceable provision shall be replaced with an enforceable provision that most closely reflects the original intent.

18. Assignment

You may not assign your rights under these Terms without our written consent. We may assign our rights and obligations under these Terms without restriction.

19. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms for specific features, constitute the entire agreement between you and Urchin regarding the use of our Services.

20. Changes to Terms

We may update these Terms periodically. Changes will be communicated through:

Your continued use of our Services after changes take effect constitutes acceptance of the modified Terms.
